Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MedSpa Butler software-as-a-service platform and related websites (collectively, the "Service") operated by MedSpa Butler ("MedSpa Butler," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

MedSpa Butler is a business-to-business platform that helps med spas automate client reminders, consent forms, treatment follow-ups, and retention outreach. The Service is intended for use by businesses and their authorized staff, not by consumers for personal use.

2. Accounts

You must provide accurate information when registering and keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be authorized to act on behalf of the business you register.

3. Subscriptions, trials, and billing

• The Service is offered on a monthly subscription basis under the plans described on our pricing page (Starter, Growth, and Pro).
• New subscriptions include a 30-day free trial. A valid payment method is required to start the trial. Unless you cancel before the trial ends, your subscription will begin and your payment method will be charged the then-current monthly fee.
• Subscriptions renew automatically each month until cancelled. Payments are processed by our third-party payment processor, Stripe, Inc.
• Fees are exclusive of taxes, which you are responsible for where applicable.

4. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation and refund terms are described in our Refund & Cancellation Policy, which is incorporated into these Terms.

5. Acceptable use

You agree to use the Service in compliance with all applicable laws, including telecommunications and messaging regulations (such as the TCPA and carrier requirements). You are responsible for obtaining any consents required to contact your clients by SMS or email, and for the content of messages you send through the Service.

6. Your data

You retain ownership of the data you submit to the Service, including your client records. You grant us a limited license to process that data solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.

7. Third-party services

The Service integrates with third-party providers (for example, Stripe for payments, Twilio for SMS, and Resend for email). Your use of those integrations may be subject to the third parties' own terms.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, MedSpa Butler will not be liable for any indirect, incidental, special, or consequential damages, or for any amounts exceeding the fees you paid to us in the twelve months before the event giving rise to the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends, though provisions that by their nature should survive will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date, and material changes will take effect going forward.
